Terms of Service

These Terms of Service ("Terms") govern your use of the Preservely website (preservely.ai) and the Preservely mobile app, operated by Everyday AI Automation LLC, doing business as Preservely ("Preservely," "we," "us," or "our"). By joining the waitlist, creating an account, or using the app, you agree to these Terms.

1. Description of the service

Preservely is an AI-powered personal finance agent. It connects to your financial accounts (through Plaid) to build what we call your Financial Brain — a verified understanding of your financial identity — and uses it to provide guidance, insights, and proactive suggestions.

Preservely is not a registered investment adviser, broker-dealer, or licensed financial planner. Nothing Preservely provides is investment, legal, or tax advice, and it is not a substitute for advice from a licensed professional. All guidance is provided for informational and educational purposes only. Preservely does not execute trades, transfers, or any financial transaction on your behalf autonomously — any action always requires your explicit review and approval.

2. Eligibility

You must be at least 18 years old, a resident of the United States, and able to form a legally binding contract to use Preservely.

3. Private beta

Preservely is currently offered as an invitation-only private beta. Features, availability, and functionality may change, break, or be discontinued at any time without notice, and we don't guarantee continuous or error-free availability. Joining the waitlist does not guarantee you'll be admitted to the beta.

4. Your account

You're responsible for providing accurate information, keeping your login credentials secure, and for all activity under your account. Let us know right away at admin@preservely.ai if you suspect unauthorized access.

5. Connecting financial accounts

When you connect a financial account through Plaid, you authorize Preservely to access, retrieve, and use data from that account as described in our Privacy Policy. You're responsible for the accuracy of the accounts you connect, and you can disconnect any account at any time within the app.

6. AI-generated content

Preservely uses third-party artificial intelligence models to generate financial insights, summaries, and suggestions. AI-generated content may contain errors or inaccuracies, does not constitute professional financial, tax, or legal advice, and you should independently verify anything AI-generated before acting on it. We're not liable for decisions made based on AI-generated content.

7. Fees

Preservely is currently free to use during the private beta. We may introduce paid plans or fees in the future; if we do, we'll give you advance notice before any charge applies to your account.

8. Acceptable use

You agree not to:

• Use Preservely for any unlawful or fraudulent purpose
• Attempt to reverse engineer, scrape, or gain unauthorized access to Preservely's systems
• Impersonate another person or misrepresent your affiliation with anyone
• Use the Preservely Agent to generate harmful, abusive, or illegal content
• Interfere with or disrupt the service or its infrastructure

9. Ownership and your data

Preservely owns the app, website, and underlying technology. The financial identity and Financial Brain built from your data belongs to you — it's portable, and you can request an export or deletion of it at any time by contacting admin@preservely.ai.

PRESERVELY IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DON'T GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED GUIDANCE, MARKET DATA, OR INSIGHT THE SERVICE PROVIDES, AND WE'RE NOT RESPONSIBLE FOR FINANCIAL DECISIONS YOU MAKE BASED ON IT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESERVELY AND ITS AFFILIATES WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY INACCURACIES IN FINANCIAL DATA DISPLAYED, OR FINANCIAL DECISIONS MADE BASED ON INFORMATION THE SERVICE PROVIDES. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.

12. Indemnification

You agree to indemnify and hold Preservely harmless from any claims, losses, or damages arising from your misuse of the service or violation of these Terms.

13. Termination

You may stop using Preservely at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service.

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a claim, you agree to first try to resolve the dispute informally by contacting admin@preservely.ai.

Note: whether to include binding arbitration and a class-action waiver here is a real legal decision, not a default we've made for you — this section intentionally stops short of that until it's reviewed with counsel.

15. Changes to these Terms

We may update these Terms from time to time. We'll post the revised date at the top of this page, and for material changes we'll provide additional notice where appropriate.
